USPTO Publishes Notice of Proposed Rulemaking to Standardize the Patent Term Adjustment (PTA) Statement Regarding Information Disclosure Statements (IDSs)

On July 12, 2022, the U.S. Patent and Trademark Office (USPTO) issued a Notice of Proposed Rulemaking in which it proposed revising the rules of practice to require that the PTA statement regarding IDSs be submitted on a standardized USPTO form. According to the USPTO, the use of such a form “will streamline certain aspects of prosecution by more accurately capturing and accounting for the [PTA] without unnecessary back-and-forth between the USPTO and applicant.”  The USPTO is requesting public comments until September 12, 2022.
