Patent-Eligibility Under 35 U.S.C. 101 in Life Sciences & Computer Arts - Are We There Yet?

The webinar will focus on the challenges in obtaining patent eligible claims in the diagnostic, computer implemented, and mechanical arts. While the arts are different, the case law in each is instructive for all of the arts. Application of current USPTO guidelines during patent prosecution will be discussed, as well as relevant case law that applies to obtaining patent eligible claims in these arts. The webinar will not only look at the present but provide suggestions where the courts may end up and how to avoid the potential pitfalls. Finally, the webinar will distill the USPTO guidelines and case law to suggest best practices for patent drafting and prosecution to avoid rejection or invalidation under 35 U.S.C. 101.
