Alexandria, Va. – The intellectual property law firm Oblon Spivak, which is located across the street from the United States Patent and Trademark Office (USPTO) and which is home to many former USPTO directors and judges, has taken a decisive lead in the area of post grant proceedings under the America Invents Act (AIA). There are now over one hundred AIA post grant proceedings pending before the USPTO, most of which are inter partes review proceedings. Oblon Spivak has solidified its position as the leader in this space by outpacing other law firms in terms of the number, diversity and commercial importance of post grant proceeding representations.

At this time Oblon Spivak has more than double the number of post grant proceeding representations than their closest competitor. Oblon Spivak has twenty-seven representations. The second place firm has eleven, and the firm ranking third has ten representations.

Oblon Spivak also leads the field with respect to the number of clients represented in post grant proceedings. Oblon Spivak’s representations are on behalf of seven different clients, including Oracle Corporation, Research in Motion, Innolux Corporation and Corelogic. This is a greater array of client representations than any other firm.

Oblon Spivak has further established itself as the go-to firm for high stakes post grant matters. For instance, Oblon Spivak is representing Ariosa Diagnostics in a inter partes review challenging a patent that allegedly blocks the entire industry and would, if the patent owner’s allegations were accepted, put the company out of business. Oblon Spivak was also selected as post-grant counsel for Innolux Corporation and Oracle Corporation for matters involving patent litigation targeting multi-billion dollar product lines.

Oblon Spivak’s lead in post-grant proceedings comes as no surprise given that the firm’s post-grant team includes many of the country’s most highly respected practitioners in this area.
