Joint Symposium on U.S. and European Patent Practice - Important Aspects for Practitioners - Fall 2025
At this 2025 joint symposium, we will together examine selected current aspects of IP practice related to prosecuting applications and enforcing patents in the U.S. and in Europe. While similarities exist, applicants for U.S. and European patents need to be aware of the peculiarities and most recent developments in each system in order to achieve the best results. In particular, the symposium will address the following important topics for today’s practitioners:
- Inter Partes Review in the U.S - including the brave new world of discretionary denials
- Statistics and recent case law of the Unified Patent Court (UPC)
- Claim construction developments in the U.S. – including the grey zone of “consisting essentially of” and impact of specification updates
- Patents on AI in Europe: from the Patent office to the Courts
- What the heck is going on in the U.S.? - USPTO updates
- “A Sole Intervenant's Guide: Navigating Claim Interpretation with Adapted Description Allies Against Marketed Product Rivals” – Enlarged Board of Appeal decisions and referrals in this year
