Further to our previous communication of May 6, 2022, the U.S. Patent and Trademark Office (USPTO) issued a brief update on June 1, 2022, regarding the termination of the Russian Federal Service for Intellectual Property (Rospatent) as an International Search Authority (ISA) and International Preliminary Examination Authority (IPEA) for international applications.
Specifically, the USPTO notified Rospatent of the USPTO’s intent to terminate their agreement concerning Rospatent functioning as an ISA and IPEA for international applications received by the USPTO as a Receiving Office under the Patent Cooperation Treaty (PCT). The USPTO indicated that the termination takes effect on December 1, 2022. Before this date, the USPTO advises applicants filing international applications under the PCT to exercise caution before selecting Rospatent as an ISA or IPEA.
