Recent Developments Relative to the Written Description Requirement of the United States Patent Law
Partners, Philippe Signore, Grace Kim, Stephen Baxter and Yuki Onoe have been invited to hold a seminar on "Recent Developments Relative to the Written Description Requirement of the United States Patent Law," in Tokyo, Japan on September 29, 2022, hosted by AIPPI Japan.
The seminar will present recent U.S. court cases and examples relating to the written description requirement, as codified in 35 USC 112(a). These cases and examples illustrate the recent trend to raise the bar of the written description requirement. In light of this new trend, the speakers will provide guidance to draft and prosecute applications in the U.S. in order to better satisfy the written description requirement.
The cases and examples presented in the seminar will cover different technologies, including mechanical, electrical, software, chemical, materials, and pharmaceuticals. Each technology raises its own issues relating to the written description requirement. For example, software claims must be supported by the appropriate algorithm for explaining how the claimed computer function is performed. For applications claiming ranges of chemical substances, the specification must sufficiently disclose these ranges. The introduction of negative limitations can raise questions, especially in pharmaceutical cases. The seminar will address these different issues from various technologies.
