Radar Patent Nixed In 1st AIA Review With Live Testimony

September 3, 2014 – In The News

Scott McKeown was quoted in Law360 regarding a favorable PTAB decision for Oblon Spivak client K-40 Electronics LLC. The first-ever live testimony given by an inventor in an America Invents Act review has failed to save an Escort Inc. radar detector patent from being invalidated, as the Patent Trial and Appeal Board has ruled that the patent is obvious and anticipated. The final written decision from Aug. 27 in the inter partes review is a win for challenger and Oblon Spivak client K-40 Electronics LLC, marking the first time the board has decided an AIA case where a witness testified in person at oral argument.

"We're obviously pleased with the outcome and think it demonstrates that when technical decision makers decide technical issues, they get down to details that may not even be reached by the district court," said McKeown.
