PTAB’s Ax Of Stanford DNA Test Patent Backed By Fed. Circ.

The Federal Circuit on Monday affirmed a Patent Trial and Appeal Board decision that the asserted claims of a prenatal DNA test patent owned by Stanford University are invalid because they are obvious and anticipated.

The appellate court panel did not expand on its reasoning in its one-sentence judgment handing a victory to accused infringer and Oblon client Ariosa Diagnostics Inc., which had successfully swayed the PTAB in November 2014 to invalidate 13 claims of Stanford's U.S. Patent Number 8,296,076.
