Oblon, Spivak's Scott McKeown is quoted in the Law360 article regarding the proposed USPTO rules affecting the scope of business method patents. Mr. McKeown commented that the definition proffered by the USPTO seemed to be an attempt to split the difference between narrowing the business method review program to a very small subset of patents and potentially opening it up to include any patent that involves financial services and technology. He said "The USPTO tried to toe the line between the two extremes". "They've been struggling for years with the concept of what a technological invention is."
