Oblon Spivak's Scott McKeown Quoted in InsideCounsel regarding the USPTO's Controversial Decision in In re Baxter
Oblon Spivak's Scott McKeown is quoted in InsideCounsel magazine regarding the U.S. Patent and Trademark offices' (USPTO) controversial decision in In re Baxter. In an ex parte re-examination, the USPTO found Baxter's invention "obvious" and voided it's patent, despite earlier rulings by the district court and Federal Circuit. Mr. McKeown said "this gives challengers two bites at the apple", encouraging infringers to challenge a patent's validity in both court and USPTO proceedings.
