Oblon Spivak's James Kulbaski is quoted in Law360 regarding Google's recent settlement with the Federal Trade Commission (FTC). Google ended a 20 month antitrust probe by the FTC by agreeing to change some of their business practices. Mr. Kulbaski said that Google really isn't giving up very much. He said the consent order will likely do little to curb Google's ability to seek injunctions because Google and the companies that it has sued differ greatly on what constitutes a reasonable royalty. "Rather than restricting injunctions on standard-essential patents, the agreement provides a blueprint for other patent owners on how they can seek injunctions in the future. If the procedures outlined in the order are followed, the government presumably will not come after you for seeking injunctive relief or an ITC exclusion order," he said.
