Oblon, Spivak's Eric Schweibenz is quoted in a recent Law 360 article regarding the Federal Circuit's decision in John Mezzalingua Associates, Inc. (d/b/a PPC, Inc.) v. ITC.  The Federal Circuit affirmed the limits on using litigation expenses to meet the domestic industry requirement.  Mr. Schweibenz commented it is very rare for the Federal Circuit to issue an opinion interpreting the language of Section 337 and it offers a tremendous amount of clarity on how this issue will be addressed going forward.
