Oblon Spivak's Alex Gasser Quoted in Managing Trade Marks Regarding Trade mark Cases at the ITC
Oblon Spivak's Alex Gasser is quoted in the above article regarding the small percentage of trade mark cases handled at the ITC. Mr. Gasser identified about five recorded trade mark decisions at the ITC, and all five were granted general exclusion orders, which is rare.
As to why there aren't more trade mark cases at the ITC, Mr. Gasser responded that the ITC bar has been asking that question. "Trade mark owners have a pretty good record at the ITC. There is something about trade mark cases that lends them to getting general exclusion orders."
