Oblon Prevails at PTAB on Behalf of Steuben Foods
The Patent Trial and Appeal Board has shut down Nestle’s bid to invalidate claims in a Steuben food packaging patent, finding Nestle failed to show that the claims were unpatentable because they were obvious. In a final written decision made public Tuesday, the PTAB said Nestle USA Inc. had not shown that a series of published writings would have allowed someone skilled in the field to build a machine that practices the invention claimed in Steuben Foods Inc.’s patent. Steuben’s patent, U.S. Patent Number 6,945,013, is directed to a system for the aseptic packaging of food products in containers. This is done with things like milk, for example, to make sure it remains sterile.
