Oblon was mentioned in a recent Law360 article regarding a recent Federal Circuit decision to vacate a PTAB decision in an inter partes review which upheld all of the claims of Verinata Health Inc.'s patent on a method of detecting fetal abnormalities. Oblon is representing Ariosa in the matter and looks forward to a second opportunity to demonstrate to the board why these patents are obvious.
Verinata and Ariosa are competitors in the field of noninvasive prenatal tests for diagnosing Down syndrome and other chromosomal abnormalities. After Verinata sued Ariosa, alleging infringement of one of its patents, Ariosa sought inter partes review. The patent-in-suit is U.S. Patent Number 8,318,430.
