Brian E. Banner concentrates his practice on the maintenance of strong brands, the adoption, use, registration of new brands and their licensing and enforcement. He has served chemical, electronic, telecommunications and manufacturing entities around the world. Mr. Banner also litigates before the Trademark Trial and Appeal Board of the USPTO and in federal court. He has managed, maintained and legally enforced large international brand estates for multinational corporations and small companies around the world. He has practical experience using the Uniform Dispute Resolution Procedure for domain names and registering copyrights at the Library of Congress. Prior to entering private practice, Mr. Banner served as a Trademark Examining Attorney at the U.S. Patent and Trademark Office, as Trademark Counsel at Munsingwear, Inc., and Monsanto Company.
With extensive business experience, Mr. Banner knows that brands identify the unique source of products and services of companies and play a key part in the United States economy. Mr. Banner assists clients in the development of strong new brands, the registration of those brands around the world and assists clients to maintain and enforce those valuable brands. As part of the Oblon Trademark and Litigation practice groups, he offers cost efficient legal services to timely address third party infringements of client’s brands in advertising, in domain names and in competitor product packaging. Mr. Banner has served as an expert witness in trademark litigation and has lectured extensively on brand enforcement matters at many different bar association and business meetings around the world.
He has and continues to write articles on trademark and unfair competition law published in World Trademark Review Daily and is one of the longest serving guest speakers at AIPLA’s annual Continuing Legal Education Trademark Bootcamp. For five years he presented an annual review of U.S. trademark case law for Continuing Legal Education credit at the District of Columbia Bar Association. In addition to serving as an Adjunct Professor of Trademark and Unfair Competition Law at Georgetown University Law School he currently teaches that subject at the George Mason University School of Law in Virginia. Mr. Banner was the Editor in Chief of the first and second editions of the treatise Trademark Infringement Remedies published by Bloomberg's Bureau of National Affairs and the ABA Section of Intellectual Property Law.
