Russian Government Resolution Adopts 0% Compensation for Infringement of Russian Patents Owned by Those Associated with Certain Foreign States

On March 6, 2022, the Government of the Russian Federation issued a decree that establishes 0% compensation for infringement of any Russian patents (invention, utility model, or industrial design) owned by patent holders deemed to be associated with certain foreign states that “commit unfriendly actions against Russian legal entities and individuals.” One day prior, a decree of the President of the Russian Federation, “on the temporary procedure for fulfilling obligations to certain foreign creditors”, established the following list of such “foreign states and territories that commit unfriendly actions against the Russian Federation, Russian legal entities[,] and individuals”:

Albania
Andorra
Great Britain (including the island of Jersey (crown possession of the British crown) and controlled overseas territories - the island of Anguilla, the British Virgin Islands, Gibraltar)
Member States of the European Union
Iceland
Canada
Liechtenstein
Micronesia
Monaco
New Zealand
Norway
The Republic of Korea
San Marino
North Macedonia
Singapore
United States of America
Taiwan (China)*
Ukraine
Montenegro
Switzerland
Japan

*identified in the decree, in Russian, as "Тайвань (Китай)”

However, neither decree identifies the term of this “temporary procedure”; neither decree defines what constitutes being “associated with” these certain foreign states; and neither decree defines what constitutes “unfriendly actions.”  Both decrees were published on March 7, 2022.
